• Currencies & Exchange Rates: While pricing may display estimated balances in your local currency based on seasonal or daily exchange rates, all orders are ultimately processed in US Dollars (USD). Your credit card company or bank determines the final exact exchange rate at the time the transaction clears. Cr3ativeGrowth is not responsible for variances in final charged amounts or subsequent refund amounts caused by currency fluctuations.
• Order Restrictions: We reserve the right to refuse or limit any order placed with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. This includes orders placed under the same customer account, credit card, or shipping/billing address. Orders suspected of being placed by unauthorized dealers, resellers, or distributors will be canceled immediately.

5. Payment Methods & Security

Our merchandise fulfillment workflow involves on-demand manufacturing and third-party logistics.

• Orders are typically processed and handed over to shipping carriers within the timelines specified on the product pages or checkout screen.
• Transfer of Responsibility: The risk of loss and title for all physical merchandise passes to you once the order is handed off to our shipping carriers. Cr3ativeGrowth is not responsible for shipping delays, theft, transit damage, package misdelivery, or incorrect shipping addresses provided by the customer at checkout.

7. Returns & Exchanges

Because our merch items are custom-manufactured and produced on-demand through our fulfillment partner, Printful, our processing windows align strictly with manufacturing compliance requirements:

• Strict 7-Day Window: Any request for a return, refund, or exchange due to product issues must be initiated strictly within seven (7) days of carrier delivery. Requests made after this 7-day window will not be eligible for review, compensation, or processing.
• Mandatory Claims Process & Documentation: To initiate an evaluation, you must email our support team at info@cr3ativegrowth.com within the 7-day window. Your email must include:
  1. A clear screenshot or digital copy of your completed bank wire/transfer transaction confirmation.
  2. Clear, high-resolution photographic proof documenting the exact physical condition of the merchandise.
  3. A detailed explanation specifying the exact nature of the problem, limited exclusively to: manufacturing defect, printing error, or wrong item size shipped.
• Condition for Review: Items must be completely unworn, unwashed, unaltered, and in their original packaging with all tags attached to be considered for an exchange or refund. We reserve the right to reject any claim if the photo documentation or physical inspection shows signs of wear, usage, customer damage, or if the claim falls outside of manufacturing error criteria.

8. Prohibited Activities

In addition to other restrictions set forth in these Terms, you are prohibited from using the site or its content:

• For any unlawful purpose or to solicit others to perform unlawful acts.
• To violate any international, federal, or state regulations, laws, or local ordinances.
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• To transmit viruses, malware, or any other type of malicious code that will or may be used to affect the functionality or operation of the website.
• To harvest or track the personal information of other users.
• To interfere with or circumvent the security features of the website.

A standard purchase and delivery contract is formed upon payment approval and is fully dissolved once successful carrier delivery is completed.

12. Severability & Entire Agreement

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. This determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms, alongside our Privacy Policy, constitute the entire agreement and understanding between you and Cr3ativeGrowth Agency, LLC, governing your use of the service and superseding any prior agreements, communications, or proposals.

These Terms and any separate agreements whereby we provide you products or services shall be governed by, interpreted, and construed in accordance with the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Any dispute, legal action, or proceeding arising out of or in connection with these Terms or purchases made on this website shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you hereby consent to the personal jurisdiction of such courts.
